Participated in an amicus brief (with the Reporters Committee and other amici) filed with the U.S. Court of Appeals for the Eleventh Circuit in Gubarev v. BuzzFeed, Inc. The brief argued that New York’s fair report privilege bars a defamation action against BuzzFeed for publishing an indisputably true and fair article about allegations (prominently labeled as unverified) compiled by an FBI informant in the “Steele Dossier” regarding Russian attempts to influence the 2016 presidential election. The brief noted that BuzzFeed’s article reported on an “official proceeding” subject to New York’s fair report privilege. The brief urged the court to affirm the district court’s ruling prohibiting a defamation action against BuzzFeed. [2019]
