Participated in an amicus brief (with other amici) filed with the U.S. Court of Appeals for the Sixth Circuit in the matter known as In Re: National Prescription Opiate Litigation. In the largest public-health lawsuit of our time, a federal district court issued a protective order barring the plaintiffs from disclosing key historical data from the Drug Enforcement Administration (DEA) about opiate sales between 2006 and 2014. The brief argues that this order improperly frustrates the public’s right of access to the data under state law without considering federalism principles. The brief urges the appellate court to reverse the district court and to vacate its protective order. [2018]
